The <ENAMEX TYPE="ORGANIZATION">Supreme Court</ENAMEX> <EVENT eid="e4" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1W">took</EVENT> a detour <TIMEX3 tid="t75" type="DATE" temporalFunction="true" functionInDocument="NONE" value="1998-W17" anchorTimeID="t73">this week</TIMEX3> from the core
principle of gender fairness it <EVENT eid="e5" class="OCCURRENCE" lowerBoundDuration="PT5M" upperBoundDuration="PT1H">vindicated</EVENT> <TIMEX3 tid="t76" type="DATE" temporalFunction="true" functionInDocument="NONE" value="1996" anchorTimeID="t73">two years ago</TIMEX3> <SIGNAL sid="s7">in</SIGNAL> its
<EVENT eid="e2031" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1M">ruling</EVENT> <EVENT eid="e8" class="I_ACTION" lowerBoundDuration="P1D" upperBoundDuration="P1M">invalidating</EVENT> the <EVENT eid="e2040" class="OCCURRENCE" lowerBoundDuration="P1W" upperBoundDuration="P3M">use</EVENT> of sexual stereotypes  to justify
denying women admission to the <ENAMEX TYPE="ORGANIZATION">Virginia Military Institute</ENAMEX>.</s> <s>By a
6-3 vote, the court <EVENT eid="e11" class="OCCURRENCE" lowerBoundDuration="PT10S" upperBoundDuration="PT5M">upheld</EVENT> a discriminatory immigration law that
gives a child born overseas to an unmarried American woman a better
chance at citizenship than a child born to an unmarried American
man.</s>
<s>Under the statute, a child born abroad to an unwed American
mother  is  automatically considered a <ENAMEX TYPE="LOCATION">U.S.</ENAMEX> citizen.</s> <s>But the child of
an unwed American father has no citizenship rights unless the
father takes the affirmative step of acknowledging paternity and
formally agrees  to provide support until the child turns <CARDINAL>18</CARDINAL>.</s>
<s>The majority's views  were <EVENT eid="e24" class="OCCURRENCE" lowerBoundDuration="PT1M" upperBoundDuration="PT1H">expressed</EVENT> in <CARDINAL>three</CARDINAL> separate opinions,
the most disquieting of which  was <EVENT eid="e25" class="OCCURRENCE" lowerBoundDuration="PT1H" upperBoundDuration="P3D">written</EVENT> by a liberal member,
<ENAMEX TYPE="ORGANIZATION">Justice John Paul Stevens</ENAMEX>, and <EVENT eid="e26" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1M">joined</EVENT> by a conservative, Chief
Justice William Rehnquist.</s> <s>The <EVENT eid="e1999" class="I_STATE" lowerBoundDuration="PT1M" upperBoundDuration="PT1H">opinion</EVENT>, which <EVENT eid="e27" class="I_STATE" lowerBoundDuration="PT1M" upperBoundDuration="PT1H">found</EVENT> the gender
distinction <EVENT eid="e1998" class="STATE" lowerBoundDuration="P1Y" upperBoundDuration="P20Y">reasonable</EVENT>, <EVENT eid="e28" class="I_STATE" lowerBoundDuration="PT1M" upperBoundDuration="PT1H">relied</EVENT> heavily on outmoded generalities
about family roles, including the flawed presumption that mothers
have a closer relationship to their children than fathers do.</s> <s>As
<ENAMEX TYPE="ORGANIZATION">Justice Stephen Breyer</ENAMEX> <EVENT eid="e32" class="OCCURRENCE" lowerBoundDuration="PT5S" upperBoundDuration="PT30S">asked</EVENT> <SIGNAL sid="s34">in</SIGNAL> a strong <EVENT eid="e33" class="OCCURRENCE" lowerBoundDuration="PT5S" upperBoundDuration="PT30S">dissent</EVENT>, ``what sense does
it make''  to apply citizenship barriers ``only to fathers and not
to mothers in <TIMEX3 tid="t79" type="DATE" temporalFunction="true" functionInDocument="NONE" value="PRESENT_REF" anchorTimeID="t73">today</TIMEX3>'s world _ where paternity can  readily be proved
and where women and men both are likely  to earn a living in the
workplace?''
Justices Sandra Day <ENAMEX TYPE="LOCATION">O'Connor</ENAMEX> and <ENAMEX TYPE="PERSON">Anthony Kennedy</ENAMEX> <SIGNAL sid="s2000">seemed</SIGNAL> to <EVENT eid="e43" class="I_ACTION" lowerBoundDuration="PT1H" upperBoundDuration="P1W">agree</EVENT>
that the law <EVENT eid="e44" class="OCCURRENCE" lowerBoundDuration="P2Y" upperBoundDuration="P30Y">amounted</EVENT> to unconstitutional sex discrimination.</s> <s>But<SIGNAL sid="s2001">instead</SIGNAL> of <EVENT eid="e45" class="I_ACTION" lowerBoundDuration="PT10S" upperBoundDuration="PT5M">providing</EVENT> the votes  to <EVENT eid="e46" class="OCCURRENCE" lowerBoundDuration="PT10S" upperBoundDuration="PT5M">strike</EVENT> it down, they <EVENT eid="e47" class="I_ACTION" lowerBoundDuration="PT1H" upperBoundDuration="P1W">chose</EVENT>  to <EVENT eid="e48" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1M">uphold</EVENT> it on the flimsy ground that because the sex of the parent
and not the child made the difference under the law, the plaintiff
did not have <EVENT eid="e51" class="I_STATE" lowerBoundDuration="P1D" upperBoundDuration="P1M">standing</EVENT>  to <EVENT eid="e52" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1M">bring</EVENT> the case.</s> <s>The <ENAMEX TYPE="ORGANIZATION">Justice Department</ENAMEX>,
which <EVENT eid="e53" class="OCCURRENCE" lowerBoundDuration="P1W" upperBoundDuration="P3M">supported</EVENT> the statute, did <SIGNAL sid="s55">not</SIGNAL> <EVENT eid="e54" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1M">cover</EVENT> itself with glory
either.</s> <s>The department <EVENT eid="e56" class="OCCURRENCE" lowerBoundDuration="P1D" upperBoundDuration="P1M">retreated</EVENT> from its position in the <ENAMEX TYPE="ORGANIZATION">VMI</ENAMEX> case

doubt both on the constitutionality of the immigration provisions
it upheld and on its true commitment to fighting gender
stereotypes.</s>
